Terms of Service

1. Agreement

By creating an account or using the Kiatu application ("App"), you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use the App.

2. What Kiatu Is

Kiatu is a running shoe management application designed to help athletes track footwear, manage training rotations, log runs, and optimize performance based on personal data you provide.

Kiatu is not a medical device, healthcare provider, licensed physiotherapist, sports medicine clinic, or fitness professional. Nothing in the App constitutes medical advice, clinical diagnosis, or prescribed treatment of any kind.

3. Health & Injury Disclaimer

The following section is important. Please read it carefully.

The injury guidance, recovery phase suggestions, shoe recommendations for injured runners, and coaching insights provided by Kiatu are based on general athletic principles and published sports science literature. They are provided for informational and motivational purposes only.

These features are NOT a substitute for professional medical advice. You must:

• Consult a licensed physician, physiotherapist, or sports medicine professional before making any training decisions when managing an existing injury or medical condition.
• Stop all activity immediately if you experience acute pain, chest pain, difficulty breathing, dizziness, or any unusual symptom.
• Not rely solely on the App when determining whether it is safe to run.

By using any injury-related, coaching, or health-adjacent feature of the App, you acknowledge and agree that Kiatu and its developers bear no responsibility, legal liability, or financial obligation for any injury, aggravation of an existing condition, adverse health outcome, or physical harm arising from or related to reliance on the App's suggestions, recommendations, or content.

4. Eligibility & Accounts

• You must be at least 13 years of age to use the App (16 years in the European Economic Area or other jurisdictions with higher minimum age requirements).
• You are responsible for maintaining the confidentiality of your account credentials. Do not share your password with anyone.
• You must provide accurate, current, and complete registration information.
• You may not transfer your account to another person.
• You must notify us immediately if you become aware of unauthorized access to your account.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to our systems, databases, or other users' accounts.
• Reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code of the App.
• Use automated scripts, bots, crawlers, or similar tools to extract data from the App.
• Upload, transmit, or introduce any malicious code, virus, or harmful component.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use the App in any manner that could damage, disable, or impair its functionality or availability.

6. Third-Party Integrations

Kiatu integrates with third-party services including Strava, Inc. Your use of any third-party integration is subject exclusively to that service's own terms, privacy policy, and practices. Kiatu is not responsible for, and has no control over, the data practices of third-party services you choose to connect.

Disconnecting a third-party integration within the App revokes Kiatu's access to that service but does not affect any data already stored in the third-party's systems.

7. Intellectual Property

The App, its underlying algorithms, design, code, content, trademarks, and all related intellectual property are owned by the developer of Kiatu. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not reproduce, distribute, sublicense, sell, or create derivative works from the App or its content without express written permission.

By submitting content to the App (such as run notes or shoe names), you grant us a worldwide, royalty-free license to use that content solely to provide the App's services to you.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any shoe recommendations, shoe life estimates, or running-related content.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Kiatu and its developers, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to:

• Physical injury or bodily harm
• Loss of data or corruption of data
• Loss of revenue, profits, or business opportunity
• Property damage

Arising out of or in connection with your use of or inability to use the App, even if advised of the possibility of such damages.

In no event shall our total cumulative liability to you exceed the greater of (a) the total amount you paid for the App in the twelve months preceding the claim, or (b) one hundred US dollars (USD $100).

10. Indemnification

You agree to defend, indemnify, and hold harmless Kiatu and its developers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of or access to the App; (b) your violation of these Terms; or (c) your violation of any rights of any third party.

11. Termination

We reserve the right to suspend or permanently terminate your account, without notice or liability, for any conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties.

You may delete your account at any time from within the App settings. Upon account deletion, your right to use the App ceases immediately and your data will be permanently deleted within 30 days.

12. Changes to These Terms

We may update these Terms from time to time. When material changes are made, we will notify you through the App and update the "Last updated" date above. Your continued use of the App after the effective date of updated Terms constitutes your acceptance of the changes.

If you do not agree with updated Terms, you must stop using the App and may delete your account.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to binding individual arbitration (not class action) to the extent permitted by law.

Nothing in this section limits your statutory rights as a consumer in your jurisdiction.

14. General

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Kiatu regarding the App.
